(a)&(b): The 7th Central Pay Commission is required to make its recommendations on its Terms of Reference. Also, the Commission is to devise its own procedure. The Commission’s Terms of Reference do not enjoin upon it to keep the Government updated on its functioning and the procedure being followed by it during the course of its deliberations.
(c ): The Terms of Reference of the Commission provide that the Commission will make its recommendations, keeping in view, inter alia, the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications.
(d)to(f): The Commission is required to submit its report on its Terms of Reference. However, no Report, including any interim one, has so far been submitted by the Commission.

(a) whether the Ministry has information on the total strength of outsourced manpower currently deployed in Government of India;
(b) to appreciate the issues related to outsourced manpower is it not necessary that Government update itself on important fact relating to this segment; and
(c) with a view to bringing about greater transparency in their hiring whether Government feels the necessity of issuing comprehensive guidelines in this regard?

(a) & (b): As per the General Financial Rules, 2005 the respective Ministries/Departments may hire external professionals, consultancy firms or consultants for a specific job or outsource certain services. No centralized data is maintained.
(c): The fundamental principles applicable to all Ministries/Departments regarding engagement of consultants and outsourcing of services are already provided in General Financial Rules 2005. The powers in respect of procurement of services including hiring of consultant(s) have been delegated to respective Ministry/Department through GFR 2005 and service/financial terms and conditions of consultant are governed as per the contract entered by the respective Ministry/Department with the Consultant(s). A Ministry/Department may outsource certain services in the interest of economy and efficiency and it may prescribe detailed instructions for this purpose.

(a) whether it is a fact that the Grade-III employees of the Multi Tasking Staff (MTS) are not being promoted and they are getting demoralized on this account;
(b) if so, since how many years, the Grade-III employees in the MTS have not got promotion; and
(c) whether it is also a fact that some of the posts of the Grade-III employees are being abolished by Government every year and if so, the details thereof?

(a) & (b): As per the provisions of the Government of India (Allocation of Business) Rules, 1961 this Department, frames/lays down guidelines/instructions on promotion which are implemented by various Ministries/Departments with whom the facts of the case/details of officers are available. Further, promotion to a post is made as per the provisions of the Statutory Recruitment Rules applicable to the post. Ministries/Departments are delegated with the powers for making the Recruitment Rules for making promotions to the Group ‘C’ posts. No such centralizeddata is maintained in this Department.
(c): This Department has not issued any instructions in this regard.

(a) whether it is a fact that there is a shortage of Specialists and Consultants in CGHS;
(b) if so, the details thereof and the reasons therefor; and
(c) the steps taken or being taken to ensure adequate availability of Specialists and Consultants in CGHS?

The recruitment of specialists is done at the level of Union Public Service Commission & Posting is done by Central Health Service. It has been noted that after appointment, very few specialists actually join the CGHS. Cases of taking voluntary retirement to join private institutions are also increasing. Some of the specialists also opt for joining other Government Institutions in the Teaching Cadre. These factors render the vacancy position more acute.
(c): In order to meet the requirement against the vacancies, the posts of Specialists /Consultants are filled on contract basis. Keeping in view the acute shortage, a proposal to engage private specialists on part time basis at dispensary level has also been approved.

hospitals provide cashless services to pensioners only for the diseases for
which they are empanelled, even during the emergencies;
(b) if so, the extant Rules and Regulations in this
regard;
(c) whether Government plans to instruct all
empanelled hospitals to provide
cashless facilities to pensioners and other CGHS beneficiaries, irrespective of diseases
for which they are empanelled during emergencies and shift the patients to
other authorized hospital after first aid;
(d) if not, the reasons therefor; and
(e) the steps proposed to check exploitation/looting of patients in emergencies by
empanelled hospitals?

(a) to (d): Recently,
the Government has amended the terms and conditions for empanelment of private hospital under the Central Government Health
Scheme (CGHS). Now, the hospitals are empanelled as a whole, meaning that all
facilities available in the hospital would be provided to CGHS beneficiaries. Disease – specific empanelment has now been
stopped.
(e): To ensure that
the terms and conditions of the Memorandum of Agreement are
followed scrupulously by the empanelled hospitals, a monitoring cell under the
aegis of a senior officer of CGHS has been established to check irregularities including exploitation
of patients. There are provisions in the MoA including issue of Show Cause
Notice, issue of warning, recovery of amount charged illegally from the beneficiaries, also confiscation of
part or whole of PBG (Performance Bank Guarantee), and ultimately removal
from the CGHS list, that can be resorted to in appropriate cases.

Measures taken by the Govt. to overcome the Inconvenience caused to Beneficiaries due to Shift in Treatment Policy of CGHS
With a view to plug the loopholes in the system, the Government decided on 25.8.2014 that only CGHS formulary medicines and those approved by Drug Controller General of India (DCGI) in India would be provided to beneficiaries under CGHS. The maximum period of issued medicines was also curtailed to one month instead of three months. It was decided ibid that only listed investigations/treatments at prescribed CGHS rates would be allowed.The following measures have since been taken to overcome the inconvenience caused to the beneficiaries due to this shift in polic
(i) The Government decided to adopt formularies of Ex- Servicemen Contributory Health Scheme (ECHS) and Employees State Insurance Corporation (ESIC) also in addition to the existing CGHS formulary.

(iii) A Group of experts has been constituted on 25.9.2014 to review CGHS formulary to avoid denial of essential medicines to CGHS beneficiaries and revising the formulary.

(iv) Instructions have also been issued to CMOs In-charge vide Office Memorandum No. 2-2/2014/CGHS/PPT/CGHS-P dated 1.10.2014 to use their discretion to supply essential medicines to CGHS beneficiaries even though they do not figure in the formularies of CGHS/ECHS/ESIC.
(v) The Government also extended further relaxation to the beneficiaries by switching back to the previous arrangement regarding time period of issued medicines i.e. 3 months for chronic disease and 6 months in case of visit abroad.
The Health Minister, Shri J P Nadda stated this in a written reply in the Rajya Sabha.

CONFEDERATION CIRCULAR NO. 20 - JCM NATIONAL COUNCIL STAFF SIDE - ALL INDIA CONVENTION ON 11.12.2014

Dear Comrades,
We send herewith copy of the letter from the Secretary, Staff Side, JCM
intimating of the decision taken by the Staff Side to hold a National
Convention at New Delhi on 11thDecember, 2014. We have already
placed the said letter in our website. The decision is the outcome of the
efforts the Confederation representatives in the Staff Side of the National
council and must be considered a step in the right direction in pursuance of
the Charter of demands, especially the important issues like wage revision,
interim relief, merger of DA, scrapping of the new Pension scheme,
privatization, outsourcing etc. As indicated in the letter of the Staff
side Secretary, the staff side is likely to meet in the second fortnight of
November, 2014 to finalize the draft declaration and the programme of
action. We shall place the draft declaration on our website as and when
the same is finalized.
Confederation is entitled to deploy 220 delegates to participate in the
convention. We have decided to invite the Confederation of Central
Government officers organizations also to participate in the convention.
The quota of delegation for the major affiliates and State Committees are
indicated in the table given below. All other affiliates and State
Committee may deploy three delegates (each) to participate in the
convention. The Convention is being held atMPCU Shah Auditorium, Sree
Gurjarathi Samaj, Raj Niwas Road, Civil Lines(Opposite Civil Lines Metro
Station), Delhi, The Convention will commence at 12 Noon and
will be concluded by 4.00 PM on 11th December,
2014.
The
timings have been so arranged to enable the comrades to reach in the morning of
11th and if necessary to return on the same day. The
delegates are requested to make their own arrangements for stay etc,if
they wish to be at Delhi earlier or later of the day of the convention.
The venue is well connected by Metro Line and from the Civil Lines Station, it
is walkable distance only. Kindly ensure that the tickets for onward and return
journey for the participating delegates are booked well in advance.
